EPA Proposes Revisions to FOIA Rule. They Are Not Enough
The U.S. Environmental Protection Agency’s proposed revisions to its Freedom of Information Act rules are unlikely to significantly enhance transparency, as they largely retain the centralized bureaucratic structures established during the Trump administration. By keeping FOIA request processing within the Office of General Counsel, the proposal leaves the door open for political appointees to influence disclosure decisions. This centralization undermines the independence of the process, allowing political factors to potentially interfere with which records are released, despite the Biden administration’s stated commitment to greater openness. The new proposal fails to eliminate mechanisms that facilitate political meddling, such as informal awareness reviews and provisions allowing officials to deem records "unresponsive." Without explicit prohibitions on these practices, politically sensitive requests remain vulnerable to internal manipulation. Furthermore, the shift toward exclusive online submission channels prioritizes administrative efficiency over public accessibility, potentially excluding individuals without reliable internet access from exercising their right to know. However, one notable improvement is the recognition of environmental justice as a valid reason for expedited processing, offering faster access to critical information for vulnerable communities. Despite this positive step, the overall framework remains insufficiently reformed to ensure robust government accountability. This article is relevant to open data advocates because it highlights the critical importance of institutional design in data governance; technical access to data is meaningless if political interference can arbitrarily restrict or delay its release, emphasizing the need for structural safeguards against censorship.
