The failure to appoint a senator as a commissioner of the National Institute for Transparency, Access to Information and Personal Data Protection (INAI) prevents the body from reaching the quorum required to hold sessions. This absence effectively paralyzes the institute’s ability to resolve public complaints, leaving citizens without a mechanism to defend their rights to information and data protection against government entities. Consequently, the democratic guarantee of transparency is severely compromised. Although authorities must still publish information and respond to requests, the lack of a full council means individual grievances cannot be adjudicated, undermining the constitutional safeguards intended for the Mexican population.
