Michigan’s Freedom of Information Act requires urgent reform to effectively serve its democratic purpose of holding government accountable. Currently, the law is undermined by three systemic failures that restrict public access to information. Exorbitant fees often exceed citizens' means, allowing officials to obscure spending and misconduct through financial barriers. Additionally, the absence of strict production deadlines enables agencies to delay releasing records indefinitely, while excessive and overly broad redactions render documents useless, hiding evidence of malfeasance from public view. To address these issues, comprehensive legislative changes are proposed to streamline access and enforce transparency. The reforms establish strict, short deadlines for record production, replacing self-imposed estimates with a mandatory maximum timeframe. Fee structures are capped and restricted to prevent agencies from using cost as an excuse for non-compliance, while redaction practices are limited to only legally mandated exemptions. These procedural shifts ensure that information is delivered promptly and completely, removing the administrative loopholes that currently allow for unnecessary secrecy and delay. This article is highly relevant to the open_data community because it illustrates the critical importance of robust legal frameworks in maintaining data accessibility. Even with data available, weak governance laws can create practical barriers that prevent meaningful public use. By advocating for lower costs, faster turnaround times, and broader data release standards, this policy brief aligns with open_data principles that prioritize usability and accountability. It demonstrates how statutory reform can directly enhance the availability and reliability of public sector data for civic engagement.
