This article argues that while Malta’s Freedom of Information Act theoretically empowers the media to enhance government transparency, it remains largely ineffective due to significant structural and procedural barriers. Despite being enacted years prior, full implementation was delayed, and the law continues to perpetuate a culture of secrecy rather than dismantling it. The legislation creates unnecessary hurdles for journalists and citizens, failing to achieve its primary goal of democratizing state institutions and holding public administration accountable for wrongdoing. The core deficiencies lie in restrictive definitions of eligibility and broad exemptions that shield key institutions from scrutiny. The requirement for five years of residency excludes many EU citizens and foreign journalists, complicating international reporting. Furthermore, blanket prohibitions prevent access to records from critical oversight bodies like the Electoral Commission and the Ombudsman. These provisions are viewed as arbitrary and undemocratic, allowing the state to withhold innocuous information and protect itself from legitimate public interest inquiries, thereby undermining the rule of law. Crucially, the law compromises judicial independence by allowing the Prime Minister to overrule the Information and Data Protection Commissioner. This power creates a conflict of interest, as the head of government effectively decides on the disclosure of his own administration’s documents, bypassing impartial tribunals. Consequently, the legislation is criticized as a mere symbolic gesture that fails to meet international standards for open data. For open data advocates, this serves as a cautionary example of how poor legislative design can render transparency laws ineffective, prioritizing government secrecy over public accountability.
