The proliferation of generative artificial intelligence has triggered a global crisis in intellectual property, as evidenced by international lawsuits against leading companies in the sector. In Chile, although there are no active lawsuits, the proposed AI bill introduces exceptions for the use of data for training purposes—a measure that experts consider insufficient and potentially unfavorable to original creators. This legislation leaves ambiguities regarding the boundaries of fair use and the prevention of covert exploitation, generating legal uncertainty and resistance from artistic associations that fear for the protection of their rights. Current regulations do not clearly define ownership of AI-generated content, allowing for contradictory interpretations among users, programmers, or the tools themselves. Given the practical impossibility of managing individual authorizations for the vast volume of data required, exception mechanisms have been adopted; however, these lack precise oversight criteria. This lack of consensus reflects a worldwide challenge, where the search for balance between technological innovation and authorship protection is complicated by the scarcity of collective management structures adapted to this new environment. This debate is crucial for the open data movement, as it underscores the urgency of developing public and transparent databases that serve as an ethical alternative to training models with protected content without consent. Promoting open resources not only seeks to resolve legal conflicts but also to ensure the diversity and richness of the content used by AI, preventing technological efficiency from being achieved at the expense of human and creative rights. Thus, open data emerges as a key solution for fostering responsible and sustainable artificial intelligence.
