A propósito de la protección de datos en el Poder Judicial: Entre la privacidad y la transparencia
The implementation of new data protection policies by the Dominican judiciary marks a significant step toward recognizing privacy in the public sector. These initiatives seek to balance two fundamental principles: judicial transparency, which is essential for an open democracy, and the safeguarding of citizens’ individual rights. By anonymizing personal information in case files before their publication, the aim is to mitigate risks associated with the disclosure of sensitive data, particularly in cases where the identities of those involved could be compromised. However, this measure introduces operational and ethical complexities, raising questions about whether restricting information constitutes a form of censorship or a legitimate form of protection. The policy allows exceptions for public figures and cases of general interest, but delegates considerable discretion to the courts to determine which data should be withheld. This reflects the inherent tension between ensuring public access to justice and preventing violations of privacy, creating a scenario where the interpretation of what is “public” versus “private” largely depends on the practical and discretionary application of these rules. The relevance of this article to open data lies in the urgency of having a robust legal framework that clearly regulates the management of public information. The absence of updated legislation generates uncertainty and potential inconsistencies in the implementation of anonymization policies, affecting the predictability and quality of the data made accessible. For transparency to be effective and respect human rights, it is crucial that data protection standards are formally integrated into the legal framework, ensuring that the openness of information does not come at the expense of individual security nor become an arbitrary mechanism of control.
