Eliminación del INAI: Un retroceso en transparencia y protección de datos
The recent constitutional reform in Mexico eliminates seven autonomous bodies, primarily aiming to reduce public expenditure by redirecting funds to the Welfare Pension Fund. However, this structural change raises profound concerns about the future of fundamental rights, particularly transparency and personal data protection. The measure lacks sufficient guarantees for the proper management of resources, potentially opening the door to opacity and discretionary handling of public assets, while undermining the institutional checks and balances essential for a healthy democracy. The elimination of the National Institute of Transparency, Access to Information and Personal Data Protection (INAI) represents the most critical risk, as its functions will be absorbed by the Anti-Corruption Secretariat under the Executive Branch. This consolidation creates an inherent conflict of interest, as the government becomes responsible for monitoring its own actions. Without the INAI’s independent oversight, the vast repository of public records and personal data faces the threat of mismanagement or misuse, leaving citizens without an impartial body to safeguard their right to access information and hold authorities accountable. This development is highly relevant to open data because it threatens the foundational principles of accessibility, integrity, and public scrutiny that sustain open government initiatives. By weakening autonomous mechanisms designed to ensure information is public by default, the reform risks reversing decades of democratic progress in data governance. Consequently, the reliability of public information decreases, erosion of citizen trust increases, and international perception of Mexico’s institutional strength diminishes, highlighting how centralized control can negatively impact the openness and utility of public data ecosystems.
