Identificando las implicaciones económicas de la Inteligencia Artificial sobre la política de derechos de autor - Almomento | Noticias, información nacional e internacional
The U.S. Copyright Office has advanced its analysis of the intersection between artificial intelligence and intellectual property, publishing the second phase of a study that examines the protection of AI-generated works and their economic impact. This process aims to clarify how existing regulations apply to automated creation, considering aspects such as infringement and the use of protected data to train models. The relevance to open data lies in the transparency needed to understand how input data affect incentives for creation and competition in the technology sector. It is clearly established that content purely generated by AI does not receive copyright protection, meaning that such parts can be freely used by anyone. Only significant human contribution is eligible for protection, even in mixed works where the author's selection and organization of the material are decisive. This distinction is crucial for defining what information circulates freely and what is restricted. Creators must explicitly exclude AI-generated material when registering their works, although the use of AI tools for research or planning does not affect the final protection. This regulation directly impacts the availability and management of open data, as it determines which intellectual assets remain in the public domain or are subject to exclusive rights, thereby facilitating or limiting access to cultural and creative information.
