¡Latinoamérica pierde el control de sus datos! Alerta por falta de soberanía digital - El Imparcial de Oaxaca

Latin America faces a digital sovereignty crisis by relying on technological infrastructures controlled by external giants, which weakens states’ capacity to protect the privacy and security of their citizens. The extraterritorial application of laws such as the Cloud Act allows foreign governments to access regional data, disregarding local jurisdictions and creating a fragmented regulatory landscape that makes it impossible to exercise real control over information. This structural vulnerability exposes the region to geopolitical and commercial risks, as cloud architecture fragments data across multiple locations beyond the reach of national legal frameworks. Despite this widespread scenario, there are isolated initiatives such as Brazil’s digital sovereignty model or artificial intelligence projects in Mexico and Colombia. However, these efforts lack a coordinated regional strategy and are often constrained by institutional weakness, insufficient funding, and the absence of robust regulatory frameworks that ensure the local storage of critical data. Technological dependence on the Global North persists, leaving most Latin American countries exposed without effective mechanisms to prevent external capture of information or to guarantee the neutrality of their digital platforms. This article is crucial for the field of *open_data* because it highlights the inherent tension between technological openness and national sovereignty. It demonstrates that the availability of data and digital services cannot be decoupled from governance and legal protection. Without policies that regulate where and how data are stored, efforts toward transparency and public access may be compromised by external interests, underscoring the need to develop open data infrastructures that respect the legal and cultural autonomy of each nation.
