El día de la Independencia nace en BC la nueva Ley de Transparencia, Acceso a la Información y la Ley de Protección de Datos Personales
Baja California has implemented a new legislative framework that promises to streamline access to public information and ensure the protection of personal data, by introducing shorter deadlines and waiving fees for most requests. However, the concentration of functions within a single secretariat and the expanded discretion to classify data as confidential pose significant risks. There is concern that these measures could limit genuine transparency through unjustified exemptions, turning a potential advance into a restrictive model where bureaucracy and hidden costs still hinder effective access. The relevance of this article to open data principles lies in the absence of fundamental technical infrastructure for interoperability and proactive data publication. Without an integrated state-wide platform or an independent guarantor body, the capacity to link government openness with real systems for procurement, audits, and budgets is weakened. This lack of autonomous institutional design prevents the creation of structured and accessible data, which are essential elements for civil society and journalists to conduct rigorous analyses and evidence-based accountability. Consequently, the impact of these reforms will depend less on their legal text and more on social pressure and constant journalistic scrutiny. Without cross-checking mechanisms or binding citizen participation, the right to know is compromised by a system that tends toward institutional enclosure. Transparency effectiveness will not be automatic; it will require active use of ARCO rights (Access, Rectification, Cancellation, and Opposition) and vigilant oversight to ensure that openness is not merely rhetorical, but a functional tool for democracy and public power accountability.
