La Nación / Ejecutivo promulgó la Ley de Protección de Datos Personales

Paraguay has enacted its Personal Data Protection Law, establishing a robust legal framework that aligns the country with international standards such as those of the OECD. The regulation aims to guarantee citizens' privacy, dignity, and security in the context of increasing digitalization, requiring that any processing of personal information have a clear legal basis and adhere to principles of transparency and privacy by design. The law creates the National Personal Data Protection Agency, endowed with functional autonomy to oversee compliance with the law and address citizens' complaints. The legislation strengthens individual rights through accessible mechanisms for accessing, correcting, and deleting data, providing legal certainty that fosters a modern, secure, and reliable digital economy for businesses and investors. It is crucial to highlight that this personal data protection law does not limit or repeal the right to access public information. On the contrary, it coexists harmoniously with government transparency legislation, ensuring that citizens retain full control over public spending and state-interest data. This distinction is relevant to the open data movement, as it clarifies how individual privacy and institutional transparency can coexist without conflict, allowing open data to flow freely without compromising people's fundamental rights.
